Este proyecto responde a un momento histórico de gran importancia, que por supuesto no pudo ser más oportuno. Colombia celebra en el año 2006 los quince años de la promulgación de su Constitución Política, y los cambios de trascendentales surgidos a partir de su aplicación has sido prolíficos, Particularmente, el tema ambiental ha sobresalido dentro de las grandes transformaciones del país, y por ello no en vano hoy se afirma que tenemos una verdades Constitución ecológica. De igual forma, la Facultad (...) de Jurisprudencia de la Universidad del Rosario conmemora los die años de la creación de la especialización en Derecho Ambiental, y tal coincidencia histórica fue una motivación adicional para proponer la realización de un análisis de la evolución normativa surtida para proponer la realización de un análisis de la evolución normativa surtida en este decenio, una evaluación de la gestión ambiental colombiana y de sus distintos impactos en una sociedad que cuenta hoy en día con herramientas constitucionales legales para la defensa de sus derechos e interese colectivos. La Universidad del Rosario ha sido parte de esta evolución, desarrollando un rol activo con el cual se han abierto espacios de discusión y de proposición de alternativas, herramientas y experiencias en pro de la protección integral de la diversidad étnica, cultural y natural de la Nación colombiana. Así, se ha constituido como facilitadora del proceso de la formación de los nuevos actores y ha tenido gran posicionamiento en procesos de participación y de estructuración de proyectos institucionales ambientales. Se comparten experiencias áulicas de la Universidad Nacional de Rosario, Argenti- na. Su objetivo es crear un instrumento para evaluar la riqueza creativa en diseño mecánico, con un método exploratorio y propositivo de validación de instrumentos y pruebas piloto sobre 156 estudiantes. Resultaron de imaginar objetos diversos, compatibles con una vista dada, y definir cinco niveles de riqueza según la canti- dad, diversidad y calidad de respuestas comparadas contra un patrón de soluciones creado por expertos. Se ensayaron cambios de (...) duración, complejidad de estímulos y presencia de soluciones preexistentes que confirmaron su potencial para investigar la creatividad en este dominio específico. According to virtue epistemology, the main aim of education is the development of the cognitive character of students (Pritchard, 2014, 2016). Given the proliferation of technological tools such as ChatGPT and other LLMs for solving cognitive tasks, how should educational practices incorporate the use of such tools without undermining the cognitive character of students? Pritchard (2014, 2016) argues that it is possible to properly solve this ‘technology-education tension’ (TET) by combining the virtue epistemology framework with the theory of extended cognition (...) (EXT) (Clark and Chalmers, 1998). He argues that EXT enables us to consider tools as constitutive parts of the students’ cognitive system, thus preserving their cognitive character from technologically induced cognitive diminishment. The first aim of this paper is to show that this solution is not sufficient to solve the TET. Second, I aim to offer a complementary and more encompassing framework of tool-use to address the TET. Then, I apply it to the educational uses of ChatGPT as the most notable example of LLM, although my arguments can be extended to other generative AI systems. To do so, in Sect. 1.1, I present Pritchard’s framework of cognitive character and virtue epistemology applied in education, to which I am committed in this treatment. In Sects. 2 and 3, I respectively illustrate Pritchard’s (2014) solution to the TET, and I highlight the general limitations of his proposal. Thus, in Sect. 4.1 I characterize ChatGPT as a computational cognitive artifact using Fasoli’s (2017, 2018) taxonomy of cognitive artifacts. In Sect. 4.2, I introduce my proposal, which combines Pritchard’s account of virtue epistemology with Fasoli’s (2017, 2018) taxonomy of cognitive artifacts to address the TET. Finally, in Sect. 5.1, I present some epistemically virtuous uses of ChatGPT in educational contexts. To conclude, I argue in favor of a multidisciplinary approach for analyzing educational activities involving AI technologies such as ChatGPT. (shrink)

An outstanding problem in so-called modal interpretations of quantum mechanics has been the specification of a dynamics for the properties introduced in such interpretations. We develop a general framework (in the context of the theory of stochastic processes) for specifying a dynamics for interpretations in this class, focusing on the modal interpretation by Vermaas and Dieks. This framework admits many empirically equivalent dynamics. We give some examples, and discuss some of the properties of one of them. En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del (...) ordenamiento jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. The aim of the article is to outline several valuable elements of Mead’s pragmatist theory of perception in action developed in his The Philosophy of the Act, in order to strengthen the pragmatist legacy of the enactivist approach. In particular, Mead’s theory of perception in action turns out to be a forerunner of sensorimotor enactivist theory. Unlike the latter, however, Mead explicitly refers to imagery as an essential capacity for agency. Nonetheless, the article argues that the ways in which Mead (...) refers to this capacity do not necessarily place it in opposition to enactivist non-representationalism. On the contrary, as a synthetic process of re-presenting of present and past sensorimotor elements, imagery can be seen as the hallmark of a pragmatically inspired sensorimotor enactivist approach that bypasses the opposition between representationalists and non-representationalists. The article argues in favour of a pragmatist enactive interpretation of the emergence of the symbolic and contentful mind from a basic form of social communicative interaction in which basic cognitive capacities are involved. Through a critical overview of Radical Enactivists (RECers)’ view about language, the article focuses on Mead’s pragmatist behavioural theory of meaning that refers to the gestural conversation as the origin of the evolution of linguistic conversation. The article develops as follows. After exposing the main elements of (...) REC’s theory of cognition and language that involve the construction of a theory of natural signs (teleosemiotics) and basic directionality (Ur-intentionality), some critical points of Hutto and Myin’s proposal will be highlighted. To foster a continuist perspective of language, the behavioural theory of meaning and language that Mead develops from the notion of gesture will be analysed. His theory is akin to REC and could augment the bare bones of REC’s sketched perspective, helping to include Ur-intentionality in a broader non-dualistic phylogenetic and ontogenetic theory of symbolic language from gestural communication, thus helping to overcome the distinction between a content-less intentionality and a content-involving intentionality, i.e., a semantic propositional intentionality. Furthermore, a recent revival of Mead’s theory testifies to its up-to-date relevance to explain the innate social dimension of human and non-human animals, and the human communicative capacity through the conditioning of bio-social canons and structures. Nuestra mirada se centró en los discursos que se balizan en un lenguaje analítico y heurístico perteneciente al universo de la normalidad de la razón analítica. En contra de esta propuesta dialogamos con Wittgenstein sobre producción de sentido y de Vygotsky sobre mediación semiótica. I investigate the character of the definite properties defined by the Basic Rule in the Vermaas and Dieks' (1995) version of the modal interpretation of quantum mechanics, specifically for the case of the continuous model of decoherence by Joos and Zeh (1985). While this model suggests that the characteristic length that might be associated with the localisation of an individual system is the coherence length of the state (which converges rapidly to the thermal de Broglie wavelength), I show in an (...) exactly soluble case that the definite properties that are possessed with overwhelming probability in this modal interpretation are delocalized over the entire spread of the state. In this paper, we discuss various aspects of Heisenberg’s thought on hidden variables in the period 1927–1935. We also compare Heisenberg’s approach to others current at the time, specifically that embodied by von Neumann’s impossibility proof, but also views expressed mainly in correspondence by Pauli and by Schroedinger. We shall base ourselves mostly on published and unpublished materials that are known but little-studied, among others Heisenberg’s own draft response to the EPR paper. Our aim will be not only to clarify (...) Heisenberg’s thought on the hidden-variables question, but in part also to clarify how this question was understood more generally at the time. (shrink)

: The article outlines some similarities between the perspectives adopted by Shaun Gallagher and William James. In particular, assuming that the issue of representation in cognitive systems provides a valuable starting point and testing ground for verifying James’ possible contribution to enactivism, we argue that there is a considerable degree of similarity between Gallagher’s and James’ non-representational models of direct perception. Furthermore, we propose that by combining James’s theory of time and spatial perception with Gallagher’s Husserlian-inspired theory of retentional-protentional structure, (...) we can strengthen the theoretical assumptions of enactivism, integrating elements taken from phenomenology and aspects of Jamesian pragmatics. Understood in this way, James’ enactive theory of action and perceptual causality provides a promising opportunity for an innovative and coherent enactivist research program. In particolare, assumendo che il tema della rappresentazione nei sistemi cognitivi fornisca un valido punto di partenza e un terreno di prova per verificare il possibile contributo di James all’enattivismo, ritengo che esista una notevole assonanza tra l’anti-rappresentazionalismo di Gallagher e la teoria della percezione diretta di James. Sostengo inoltre che attraverso una combinazione della teoria del tempo e della percezione spaziale di James con la teoria di Gallagher della struttura ritentivo-protensiva di ispirazione husserliana sia possibile rafforzare i presupposti teorici dell’enattivismo, integrando elementi tratti dalla fenomenologia con aspetti pragmatisti. La teoria jamesiana dell’azione e della causalità percettiva sembra fornire una promettente opportunità per un innovativo programma di ricerca in ambito enattivista. Despite society’s increasing sensitivity toward green production, companies often struggle to find effective communication strategies that induce consumers to buy green products or engage in other environmentally friendly behaviors. To add clarity to this situation, we investigated the effectiveness of negative versus positive message framing in promoting green products, whereby companies highlight the detrimental versus beneficial environmental consequences of choosing less versus more green options, respectively. Across four experiments, we show that negatively framed messages are more effective than positively framed (...) ones in prompting consumers to engage in pro-environmental behaviors. More importantly, we find that anticipated shame is the emotion responsible for this effect. Furthermore, both environmental concern and the type of product promoted serve as moderators; thus, the mediating role of anticipated shame is attenuated when environmental concern is low and the product is a luxury one. Finally, we discuss the theoretical and managerial implications of our work, along with its limitations and some directions for future research. (shrink)

Using the formalism of decoherent histories, it investigates whether intuitions about intrinsic time directedness that are often associated with probability can be justified in the context of no-collapse approaches to quantum mechanics. The standard approach to time symmetry in the decoherent histories literature is criticised, and an alternative approach is proposed, based on two decoherence conditions within the one-vector formalism. In turn, considerations of forwards (...) and backwards decoherence and of decoherence and recoherence suggest that a time-directed interpretation of probabilities, if adopted, should be both contingent and perspectival. The Heisenberg microscope and its analysis by Weizsäcker are used by Grete Hermann in her 1935 essay on the foundations of quantum mechanics to argue her claims about causality in quantum mechanics. In this chapter, I wish to draw a comparison between Hermann’s use of the Heisenberg microscope and another famous use of a very similar thought experiment : Bohr’s analysis of the suspended single slit in his reply to EPR. I shall argue that Hermann’s use of different aspects of (...) the classical pictures in the treatment of the Heisenberg microscope makes her treatment closer to Bohr’s discussion of the suspended slit than to Heisenberg’s own treatment of the microscope. This suggests that Hermann, who equally gave an extensive analysis of complementarity in her 1935 essay, may be an especially acute interpreter of Bohr’s views. I conclude by looking at Hermann’s approach in the context of more general examples of measurement and at possible limitations of the approach. (shrink)

This paper critically examines I.I. Rubin's Essays on Marx's Theory of Value and argues that two different approaches to value theory can be found in that book: a more 'production-centred' value-form theory uneasily co-exists with a 'circulationist' perspective. This unresolved tension, the authors claim, reflects a more general theoretical shortcoming in Rubin's work, namely, a problematic conceptualisation of the inner connection between materiality and social form that eventually leads to a formalist perspective on the value-form. Furthermore, the paper argues that (...) all those antinomies are an expression of the historical and political context underlying Rubin's work, in which Marxism was being codified as state ideology. The political implications of Rubin's formalism are explored through the critical examination of its consequences for the comprehension of the social determinations of the revolutionary subjectivity of the working class. The article highlights George Herbert Mead’s and Wilfrid Sellars’ reliance on a behaviourally-grounded conception of meaning as strictly related to the possibility of distinguishing mental from non-mental phenomena as both related to the semantic dimension. Mead’s position is in fact akin to Wilfrid Sellars’ argument that the concepts of ‘inner events’ are essentially inter-subjective. Thoughts are displayed as consisting of related linguistic acts linked inferentially through intra-linguistic moves that respond to a particular ‘language practice’ governed by norms. Introspection is an (...) ‘inner conversation’, namely an ‘inner’ speaking analogous to linguistic activity that does not involve actual equivalents of the words in the mind. (shrink)

Many political libertarians argue, or assume, that negative moral duties (duties not to harm others) prevail over positive moral duties (duties to aid others), and that the legal system ought to reflect such pre-eminence. I call into question this strategy for defending a libertarian order. I start by arguing that a successful account of the well-known case of a runaway trolley that is about to kill five innocents unless a passer-by diverts it onto one innocent, killing him, should point to (...) (i) the ex ante advantage to all six of being subject to a policy of redirection of runaway trolleys, and (ii) the causal structure of killing vs. letting-die choices. I then argue that this account of the trolley case entails that legal systems reflecting the relative stringency of negative and positive moral duties should uphold redistributive measures at odds with libertarianism. The assumption that the legal system ought to reflect, through non-causal routes, moral principles and their relative weights leads to either an ideal-theory (in Rawls's sense) assessment of libertarianism or a symbolic account of the relationships between morality and law. Libertarians should undermine this assumption if they hope to offer an all-things-considered case for free markets. (shrink)

An important feature of some recent jurisprudential writings is the tendency to reject the precept of liberal individualism which affirms the priority of the principles of the "right conduct" over the substantive conceptions of "the good". This rejection, explicit in a recent book by Rogers M. Smith, and implicit in a recent work by Guido Calabresi, leads to strikingly illiberal consequences; hence, this provides indirect confirmation that the priority of the right over the good constitutes the most reliable defense (...) of individual liberty against majoritarian oppression. In Smith, an attempt to replace this priority with the principle of "rational liberty" leads to the disappearance of the guarantees of minority rights against orthodox majorities; in Calabresi, the doctrine of weighing and balancing competing moral principles of "the good" fails to provide an explanation for the strongly held moral intuition that some external preferences have to be disqualified at the outset, before they enter the forum of moral bargaining. ABSTRACTThe paper compares Mead’s and Quine’s behaviouristic theories of meaning and language, focusing in particular on Mead’s notion of sympathy and Quine’s notion of empathy. On the one hand, Quine seems to resort to an explanation similar to Mead’s notion of sympathy, referring to ‘empathy’ in order to justify the human ability to project ourselves into the witness’s position; on the other hand, Quine’s reference to the notion of empathy paves the way to a more insightful comparison between Mead’s behaviourism (...) and an explanation of the emergence of the linguistic from pre-linguistic communication based on empathic identification processes. However, Mead is less ambiguous than Quine in his use of the notion of sympathy finds a fecund parallel in the current neuroscientific and neuro-phenomenological hypothesis on ‘empathy’. The article contends that the ambiguity in Quine’s account of empathy is due to the exigency of trying to elucidate the link between the rules of language in a cultural context and... (shrink)

The celebrated Dreimännerarbeit by Born, Heisenberg and Jordan contains a matrix-mechanical derivation by Jordan of Planck’s formula for blackbody fluctuations. Jordan appears to have considered this to be one of his finest contributions to quantum theory, but the status of his derivation is puzzling. In our Dreimenschenarbeit, we show how to understand what Jordan was doing in the double context of a Boltzmannian approach to statistical mechanics and of the early ‘statistical interpretation’ of matrix mechanics.

The paper seeks to show the potentialities of a wider perspective concerning human economic behavior and decision-making processes intertwining Mead’s and Sen’s ideas on self-identity and social context. Emerging developments of my findings strengthen, at once, the principled commitment to freedom of choice, revealing from a “Mead-Sen” perspective the instrumental role of social behavioral patterns and socio-cultural environment (social group, community, nationality, race, sex, and now social media) in the orientation of persons’ (economic) behaviors. In particular, a Mead-Sen approach would (...) help clarify how people develop their attitudes and dispositions to think and behave, namely examining the habits at the basis of everyday processes of evaluation and choice as manifestations of practical judgment.
